Acceptance of Terms

Your access or use of the Services constitutes unconditional acceptance of these Terms. If you do not agree, you must immediately discontinue usage. These Terms form a legally binding agreement under the Indian Contract Act, 1872.

Sarpanch Sagar Shelar provides professional digital communication services including but not limited to:

  • WhatsApp Business Official API onboarding and messaging
  • RCS business messaging services
  • Customer notification and engagement systems
  • Message automation and delivery solutions
  • Business communication compliance support

We reserve the right to modify, suspend, or discontinue any service without prior notice.

Eligibility

Users must be at least 18 years of age and legally competent to enter into contracts under Indian law. Businesses must be legally registered and authorized to send business communications.

Account Registration

To access certain services, users may be required to create an account and submit accurate business information. You are solely responsible for maintaining confidentiality of your credentials and all activities under your account.

User Responsibilities

Users agree:

  • Not to send spam, fraudulent, misleading, or illegal content
  • To comply with Meta, Google, telecom, and Indian regulatory policies
  • To obtain lawful consent from recipients before sending messages
  • Not to misuse or abuse messaging platforms

Violation may result in immediate suspension or termination.

Payment & Billing Terms

Fees are charged as per agreed plans or invoices. All payments are non-refundable unless explicitly stated. Taxes including GST shall be borne by the User as applicable.

Subscription Renewal & Termination

Subscriptions may auto-renew unless cancelled. We reserve the right to terminate access for non-payment, policy violations, or regulatory reasons without liability.

Use of WhatsApp Official API & RCS

Users acknowledge that WhatsApp and RCS services are governed by third-party policies. Sarpanch Sagar Shelar acts as a service facilitator and does not control Meta, Google, or telecom operator decisions.

Message Delivery & Compliance Policy

Message delivery depends on network conditions, recipient availability, and platform approvals. We do not guarantee delivery success. Users are responsible for content compliance.

Intellectual Property Rights

All software, content, branding, and documentation are proprietary to Sarpanch Sagar Shelar. Unauthorized copying, resale, or reverse engineering is prohibited.

Confidentiality

Both parties agree to protect confidential information obtained during service usage and not disclose it except as required by law.

Disclaimer of Warranties

Services are provided “as is” without warranties of any kind. We disclaim all implied warranties including merchantability and fitness for a particular purpose.

Limitation of Liability

Our liability shall not exceed the amount paid by the User in the preceding three months. We are not liable for indirect, incidental, or consequential damages.

Indemnification

Users agree to indemnify and hold harmless Sarpanch Sagar Shelar from claims arising from misuse of services, legal violations, or third-party complaints.

Governing Law (India)

These Terms are governed by the laws of India. Courts in Pune, Maharashtra shall have exclusive jurisdiction.

Changes to Terms

We may revise these Terms at any time. Continued usage constitutes acceptance of revised Terms.
